रायपुर नगर निगम के डिप्टी कमिश्नर के ट्रांसफर पर रोक: नगरीय प्रशासन विभाग ने सीनियर अफसर का जूनियर पद पर तबादला
रायपुर नगर निगम के डिप्टी कमिश्नर कृष्णा खटिक के तबादला आदेश पर हाईकोर्ट ने रोक लगा दी है। दरअसल, नगरीय प्रशासन विभाग ने नियमों को दरकिनार कर सीनियर अफसर को जूनियर पद पर ट्रांसफर कर दिया है। बता दें कि याचिकाकर्ता का तबादला नगर पालिका महासमुंद में CMO के पद पर किया गया था।
राज्य शासन के नगरीय प्रशासन विभाग ने हाल ही में अफसरों का ट्रांसफर आदेश जारी किया है। इस तबादला आदेश में राज्य शासन की तय सेवा शर्तों का उल्लंघन किया गया है। इसमें राज्य शासन के अफसर अपने ही बनाए नियमों और शर्तों का पालन नहीं कर रहे हैं। ऐसे ही रायपुर नगर निगम में पदस्थ डिप्टी कमिश्नर कृष्णा खटिक का तबादला महासमुंद सीएमओ के पद पर किया गया है, जो जूनियर पद है।
ट्रांसफर आदेश को हाईकोर्ट में दी चुनौती
नगरीय प्रशासन विभाग में ग्रेड एए के अधिकारी कृष्णा खटिक ने एडवोकेट संदीप दुबे के माध्यम से हाईकोर्ट में याचिका दायर की है, जिसमें उन्होंने तबादला आदेश के माध्यम से ग्रेड डिमोशन करने को चुनौती दी। इसमें बताया कि नगरपालिका महासमुंद सीएमओ का पद उससे जूनियर रैंक के अफसर की है। याचिकाकर्ता ग्रेड AA के अफसर हैं। लेकिन, राज्य शासन ने ट्रांसफर आदेश के जरिए उन्हें ग्रेड A अफसर बना दिया है। यह एक तरह से डिमोशन है
याचिकाकर्ता ने कहा कि सीएमओ पद पर ग्रेड A रैंक के अफसर की पदस्थापना की जानी चाहिए। एडवोकेट संदीप दुबे ने कोर्ट को बताया कि याचिकाकर्ता का तबादला आदेश राज्य शासन के नगर पालिका (कार्यपालिक/इंजीनियरिंग/स्वास्थ्य) सेवा, भर्ती और सेवा की शर्तें नियम, 2017 के खिलाफ है।
