छत्तीसगढ़ उच्च न्यायालय ने बिजली ट्रांसमिशन लाइन और टावर निर्माण को लेकर महत्वपूर्ण फैसला सुनाया है।
बिलासपुर। छत्तीसगढ़ उच्च न्यायालय ने बिजली ट्रांसमिशन लाइनों और टावरों के निर्माण को लेकर अहम फैसला सुनाया है। कोर्ट ने स्पष्ट किया है कि बिजली अधिनियम और टेलीग्राफ एक्ट के तहत सार्वजनिक हित में ट्रांसमिशन लाइन बिछाने या बिजली टावर खड़े करने के लिए जमीन मालिक की पहले से अनुमति लेना अनिवार्य नहीं है। न्यायालय ने कहा कि बिजली पारेषण राष्ट्रीय महत्व का कार्य है। ऐसे मामलों में जमीन मालिक को केवल नियमों के अनुसार मुआवजे का अधिकार प्राप्त है। वह केवल इस आधार पर निर्माण कार्य रोकने के लिए स्थगन आदेश की मांग नहीं कर सकता कि उसकी जमीन पर टावर लगाया गया है। यह आदेश छत्तीसगढ़ उच्च न्यायालय के न्यायमूर्ति अमितेन्द्र किशोर प्रसाद की एकल पीठ ने ‘ए.एस. एसोसिएट्स’ की याचिका पर सुनवाई करते हुए जारी किया।
टावर हटाने और 5 लाख मुआवजे की थी मांग
मामले में याचिकाकर्ता फर्म ‘ए.एस. एसोसिएट्स’ के भागीदार आदित्येंद्र शुक्ला, निवासी रायपुर ने अपनी आवंटित जमीन पर बिजली टावर लगाए जाने के खिलाफ हाई कोर्ट में याचिका दायर की थी। याचिकाकर्ता की ओर से अधिवक्ता विपिन तिवारी ने पैरवी करते हुए मांग की थी कि संबंधित अधिकारियों को जमीन से बिजली टावर हटाने का निर्देश दिया जाए। साथ ही टावर हटाने का खर्च विभाग उठाए और जमीन के कथित अवैध उपयोग के लिए 5 लाख रुपये मुआवजा दिया जाए। सुनवाई के दौरान बिजली कंपनी और अन्य प्रतिवादियों की ओर से बताया गया कि यह मामला हाई कोर्ट के पुराने फैसले ‘जयकुमार अग्रवाल बनाम छत्तीसगढ़ राज्य’ से जुड़ा हुआ है। इस फैसले को डिवीजन बेंच भी सही ठहरा चुकी है। याचिकाकर्ता के वकील ने भी इस कानूनी स्थिति पर कोई आपत्ति नहीं जताई।
बिजली पारेषण को बताया राष्ट्रीय महत्व का काम
हाई कोर्ट ने पुराने फैसले के कानूनी सिद्धांतों को दोहराते हुए कहा कि बिजली पारेषण देश के विकास और जनहित से जुड़ा महत्वपूर्ण कार्य है। छत्तीसगढ़ एक ‘पावर हब’ है, जहां से पूरे देश में बिजली की आपूर्ति की जाती है। कोर्ट ने कहा कि विकास कार्यों और सार्वजनिक हित की परियोजनाओं के लिए ट्रांसमिशन लाइन बिछाने में अधिकारियों को जमीन मालिक से अनुमति या पूर्व नोटिस लेने की आवश्यकता नहीं है।
जमीन का मालिकाना हक रहेगा सुरक्षित
न्यायालय ने अपने आदेश में यह भी स्पष्ट किया कि बिजली टावर लगाए जाने से संबंधित कंपनी या विभाग को जमीन पर मालिकाना अधिकार नहीं मिल जाएगा। जमीन का शीर्षक और स्वामित्व ‘ए.एस. एसोसिएट्स’ के पास ही रहेगा। कंपनी केवल टावर और उससे जुड़े उपयोग वाले हिस्से का इस्तेमाल कर सकेगी। कोर्ट ने याचिका का निपटारा करते हुए निर्देश दिया कि निर्माण से हुए नुकसान के लिए याचिकाकर्ता को नियमानुसार उचित मुआवजा दिया जाए। संबंधित अधिकारियों को आदेश की प्रति मिलने के 60 दिनों के भीतर याचिकाकर्ता की सुनवाई कर मुआवजा राशि का भुगतान सुनिश्चित करने के निर्देश दिए गए हैं। साथ ही याचिकाकर्ता को बिजली टावर के संचालन और संबंधित कार्यों में किसी तरह की बाधा उत्पन्न नहीं करने को कहा गया है।
