नई दिल्ली — निर्भया मामले में जिला प्रशासन और निर्भया के माता पिता की दोषियों के नये डेथ वारंट जारी करने की याचिका पर पटियाला हाऊस कोर्ट में अतिरिक्त सत्र न्यायाधीश धर्मेंद्र राणा फिर से सुनवाई करेगी। दोषी पवन को अदालत की ओर से मुहैया करवाये गये नये वकील रवि काजी पहली बार इस मामले में पवन का पक्ष रखेंगे। और यह भी बतायेंगे कि पवन की ओर से क्यूरेटिव या दया याचिका दायर की गई या नहीं। वहीं दूसरी ओर निर्भया के पक्ष के वकील दोषियों की फांसी के लिये नया डेथ वारंट जारी करने की मांग करेंगे। इससे पहले पिछले वकील एपी सिंह अदालत में पवन की पैरवी कर रहे थे।
तीन दोषियों के सभी विकल्प खत्म
गौरतलब है कि फिलहाल निर्भया के तीन दोषियों विनय, मुकेश और अक्षय के सभी कानूनी विकल्प खत्म हो चुके हैं लेकिन चौथे आरोपी पवन के पास अभी भी क्यूरेटिव और दया याचिका दायर करने का मौका है।हालांकि पांच फरवरी को हाईकोर्ट ने दोषियों के सभी कानूनी विकल्पों के उपयोग का अल्टीमेटम दिया गया था, लेकिन इस अवधि के बीच दोषी पवन की ओर से कोई याचिका दायर नहीं की।
तीसरा डेथ वारंट हो सकता है जारी
अगर पवन की ओर से क्यूरेटिव या दया याचिका दायर नहीं की जाती तो अदालत नियमों के तहत चारों दोषियों को फांँसी देने के लिये नया डेथ वारंट जारी कर सकती है। यह नियम है कि अगर किसी दोषी की कोई याचिका लंबित नहीं है तो डेथ वारंट जारी किया जा सकता है। हालांकि दोषी पवन के पास अभी भी क्यूरेटिव और दया याचिका दायर करने के विकल्प मौजूद है।
