बिलासपुर, हाईकोर्ट ने अजीत जोगी की जमानत याचिका पर सुनवाई हुई। कोर्ट ने जाति मामले की सुनवाई के साथ ही फैसला दिया कि एफआईआर क्रिमिनल बेंच का मामला है। इसलिए सिविल न्यायालय में जमानत दिया जाना उचित नहीं होगा। कोर्ट ने अपने फैसले में कहा कि राज्य सरकार जोगी की जाति और छानबीन के बाद हासिल दस्तावेजों को पेश करे। जोगी की विधायिकी बरकरार रहेगी। फैसले में कोर्ट ने बताया कि जाति मामले की सुनवाई 19 सितम्बर से लगातार होगी। सुनवाई के दौरान कोर्ट ने संतकुमार नेताम,समीरा पैकरा और नन्दकुमार साय की याचिका को निरस्त कर दिया है।
अजीत जोगी के वकील और सुप्रीम कोर्ट के जाने माने अधिवक्ता राहुल त्यागी ने बताया कि एफआईआर के साथ पुलिस कार्रवाई और जाति मामला दो अलग अलग बाते है। हाईकोर्ट ने अजीत जोगी को जाति मामले में राहत मिली है। जाति का मामला सिविल कोर्ट का है। मामले की सुनवाई लगातार 19 सितम्बर से चलेगी। कोर्ट ने राज्य शासन से दस्तावेजों की मांग किया है। चूंकि एफआईआर और पुलिस का मामला क्रिमिनल बेंच का है। इसलिए कोर्ट का स्पष्ट निर्देश दिया कि फिलहाल एफआईआर और पुलिस प्रक्रिया अलग मामला है। उसके लिए अलग से जमानत याचिका क्रिमिनल बैंचे में पेश किया जा सकता है।
संकट में आ जाएगी सरकार
इधर मामले में पूर्व मुख्य मंत्री अजीत जोगी ने बताया कि चूंकि जाति का मामला काफी पुराना 1967 का है। जाति मामले को लेकर बहुत बाद में कानून आया है। मामला मुझ पर बनता ही नहीं है। ऐसे में गिरफ्तारी से बचने जमानत याचिका पेश करने का सवाल ही नहीं उठता है। जोगी ने स्पष्ट किया कि तलाक का कानून हाल फिलहाल बना है।ऐसी सूरत में पुराने लिए गए तलाक पर किसी प्रकार की कार्रवाई का होना नामुमकिन है। यदि ऐसा किया जाएगा तो संविधान और कानून के खिलाफ होगा। मतलब पुराने मामले में नए कानून लागू नहीं होंगे।
अजीत जोगी ने कहा कि आर्टिकल 20 के तहत उनके खिलाफ जाति को लेकर एफआईआर जैसा मामला बनता ही नहीं है। एफआईआर और गिरफ्तारी से बचने कोर्ट जाएंगे के सवाल पर जोगी ने कहा कि कोर्ट जाने और गिरफ्तारी का सवाल ही नहीं उठता है। क्योंकि गिरफ्तारी करना संविधान के खिलाफ होगा। यदि गिरफ्तारी हुई तो सरकार संकट में पड़ जाएगी। मैं दो एक दिन के अन्दर दिल्ली से बिलासपुर लौट रहा हूं। दिल्ली स्वास्थ्य चेकअप के लिए आया था। काम पूरा हो गया है।मैं पूरी तरह से स्वस्थ हूं। यह कहना कि गिरफ्तारी से बचने का प्रयास कर रहा हूं।सरासर गलत है। क्योंकि एफआईआर ही गलत है।
बता दें हाइपावर कमेटी की रिपोर्ट के बाद कलेक्टर ने तहसीलदार तुलाराम भारद्वाज की शिकायत पर सिविल लाइन थाने में जोगी के खिलाफ जाति मामले को लेकर एफआईआर दर्ज किया गया था। ।
