ऐतिहासिक खबर जो हम सब को जानना चाहिये : दुष्कर्म पीड़िता के गर्भपात मामले पर शासन की ओर से महाधिवक्ता सतीश ने दिया जवाब – माँ – बच्चे की आजीवन जिम्मेदारी उठाएगी सरकार

बिलासपुर। दुष्कर्म पीड़िता ग्यारह वर्षीय बालिका और उसके होने वाले बच्चे की आजीवन देखरेख और समस्त खर्चों की जिम्मेदारी राज्य सरकार ने ले ली है. इसकी जानकारी महाधिवक्ता सतीश चंद्र वर्मा ने गर्भपात कराने की पीड़िता की याचिका के मामले में हाईकोर्ट को दी है.
दरअसल बालोद जिले के डौंडी में रहने वाली ग्यारह वर्षीय बालिका के साथ सबतरुराम पटेल नाम के युवक ने दुष्कर्म किया था. पीड़िता के अभिभावकों ने अपने वकील के माध्यम से बिलासपुर हाईकोर्ट में गर्भपात कराने की याचिका दाखिल की थी. सुनवाई के दौरान पीड़ित बालिका का 27 सप्ताह ( 6 महीने ) का गर्भ हो चुका था. मामले में सुनवाई करते हुए उच्च न्यायालय की एकल पीठ के जस्टिस पी सैम कोशी ने मेकाहारा की दो महिला स्पेशलिस्ट डॉक्टरों से जांच कराने का आदेश दिया था. न्यायालय ने दोनों डॉक्टरों से पूछा था कि मेडिकल टर्मिनेशन ऑफ प्रेग्नेंसी करवाने से नाबालिग पीडिता की जान को कोई खतरा तो नहीं रहेगा ?
मामले में मेडिकल कॉलेज रायपुर की विशेषज्ञ डॉ नलिनी मिश्रा एवं डॉ रूचि किशोर की टीम ने बालिका की पुनः जांच के बाद अपनी रिपोर्ट दी कि एमटीपी एक्ट 1971 के अंतर्गत निर्धारित गर्भपात हेतु 20 सप्ताह की समय सीमा से यह काफी अधिक होने के कारण गर्भ को जारी रखने एवं गर्भपात कराये जाने, दोनों ही अवस्था में जान के जोखिम की संभावना रहेगी. डॉक्टरों ने अपनी रिपोर्ट में यह भी कहा था कि न्यायालय के निर्देश एवं बच्ची के अभिभावक के सहमति से गर्भपात करवाया जा सकता है.
बुधवार को इस मामले में फिर से सुनवाई हुई. मामले में डॉक्टरों द्वारा दी गई पीड़िता की जांच रिपोर्ट को न्यायालय में पेश किया गया. उधर महाधिवक्ता सतीश चंद्र वर्मा ने इस मामले में न्यायालय के सामने राज्य शासन का पक्ष रखा. शासन ने इस प्रकरण को असाधारण प्रकरण मानते हुए संवेदनशील रवैय्या अपना रहा है. जिसके तहत दुष्कर्म पीड़िता बालिका और उसके होने वाले बच्चे की गहन चिकित्सा, समस्त देखरेख एवं व्यय की जिम्मेदारी शासन की रहेगी. इसके साथ ही मां और बच्चे की जिम्मेदारी आजीवन राज्य सरकार उठाएगी.
महाधिवक्ता सतीश चंद्र वर्मा ने कोर्ट में डॉक्टरों की रिपोर्ट के आधार पर अपनी दलील दी कि दोनों ही स्थिति में मां और बच्ची की जान को खतरा हैं. उन्होंने कोर्ट से कहा कि, “दो की मौत की बजाय दो की जिंदगी की ओर बढ़ना पसंद करेंगे.” जिस पर न्यायालय महाधिवक्ता की इस दलील पर सहमत हुई कि दोनों स्थितियों में खतरा है. बच्ची को गर्भ ठहरे 6 माह से ज्यादा का समय बीत चुका है लिहाजा विशेषज्ञ डॉक्टरों की देखरेख में सुरक्षित प्रसव होना चाहिए
