तिल्दा नेवरा. नगरपालिका तिल्दा नेवरा के अध्यक्ष महेश अग्रवाल के खिलाफ की गई अनर्गल बयान बाजी भाजपा नेताओं अनिल अग्रवाल और सौरभ जैन को अब मंहगी पड़ती दिख रही है।हाई कोर्ट ने महेश अग्रवाल द्वारा लोअर कोर्ट में दाखिल मानहानि मामले के विरुद्ध भाजपा नेताओं की अपील को खारिज कर दिया। दरअसल यह मामला वर्ष 2016 का है, जब भाजपा नेताओं द्वारा स्थानीय दीनदयाल चौक में आम सभा का आयोजन कर पालिका अध्यक्ष पर आधारहीन आरोप लगाए थे। भाजपा के जिला कोषाध्यक्ष अनिल अग्रवाल और शहर महामंत्री सौरभ जैन ने अपने भाषण में कहा था कि नगरपालिका में 10 रुपये के झाड़ू को 90 रुपये में खरीदा जा रहा है, तथा पालिका अध्यक्ष द्वारा एन ओ सी के लिए पैसे की मांग की जा रही है। अपने खिलाफ इस तरह की आधारहीन और अनर्गल बयानबाजी से तंग आकर पालिका अध्यक्ष महेश ने तिल्दा कोर्ट में धारा 500 के तहत मानहानि का मामला दायर किया था। लोअर कोर्ट से मामला खारिज होने के बाद महेश अग्रवाल द्वारा सेशंस कोर्ट में अपील की थी। तब सेशंस कोर्ट ने दिनांक 9/11/2017 को ट्रायल कोर्ट को निर्देशित किया था कि मामले को धारा 500 के तहत चलाया जाए।
भाजपा नेताओं ने सेशंस कोर्ट के इस आदेश को हाइकोर्ट में चुनौती दी थी। उन्होंने अपने क्रिमिनल रिविज़न में अपने अधिवक्ताओं के माध्यम से कहा कि यह मामला कोर्ट में चलने लायक नहीं है तथा उन्होंने अभव्यक्ति की आजादी के तहत अपनी बात रखी थी। महेश अग्रवाल के वकील ने कहा कि इस बात के सभी तथ्यात्मक दस्तावेज उपलब्ध हैं जिनसे यह सिद्ध होता है कि पालिका अध्यक्ष महेश अग्रवल की छवि खराब करने के उद्देश्य से बिना किसी आधार के उन पर सार्वजनिक रूप से अनर्गल आरोप लगाए गए है।
अपने फैसले में न्यायाधीश श्री राजेन्द्र चंद सामंत ने कहा कि इस बात के पर्याप्त साक्ष्य है कि पक्षकार क्र. 2 महेश अग्रवाल के विरुद्ध याचिकाकर्ताओं द्वारा मानहानि कारक बयान दिया गया है जिससे उनकी छवि पर असर पड़ा है इसलिए यह क्रिमिनल रिव्यु पिटीशन खारिज की जाती है। हाई कोर्ट से अपील खारिज होने के बाद अब भाजपा नेताओं के विरुद्ध आपराधिक मानहानि का मामला ट्रायल कोर्ट में चलेगा। उल्लेखनीय है कि भाजपा नेताओं द्वारा तिल्दा नेवरा पालिका चुनाव के बाद से ही नकरात्मक राजनीति की जा रही थी उनकी झूठी शिकायतों के कारण नगरपालिका के कई विकास कार्य भी भाजपा शासन में रुके थे जो अब कांग्रेस शासन आने के बाद फिर से चालू हुए हैं। पालिका अध्यक्ष महेश अग्रवाल से इस संबंध में बात करने पर कहा गया कि मेरी छवि खराब करने के उद्देश्य से उक्त भाजपा नेताओं द्वारा मुझ पर सरेआम झूठे आरोप लगाए जा रहे थे इस लिए मैंने तंग आकर उनके खिलाफ मानहानि का मुकदमा दायर किया है, उनकी अपील को हाइकोर्ट ने खारिज कर दिया है । मेरा भारत की न्याय व्यवस्था पर पूरा भरोसा है मुझे विश्वास है कि जल्द ही ट्रायल कोर्ट से भी मुझे न्याय मिलेगा।
