कर चोरी करने वाले व्यवसायियों के विरूद्ध स्टेट जीएसटी की बड़ी कार्यवाही

बिलासपुर 31 मई 2025 / मेसर्स बंसल ट्रेडिंग कार्पोरेशन, अंबिकापुर के व्यवसाय स्थल पर स्टेट जीएसटी विभाग अंबिकापुर द्वारा 29 मई को जांच की कार्यवाही की गई है। भारत सरकार द्वारा संचालित जीएसटी पोर्टल के अनुसार इनका रिस्क स्कोर 10 आ रहा था, जिसका आशय होता है कि फर्म कर अपवंचन में संलिप्त है। जब मौके पर जांच टीम पहुंची तो, देखा कि उनके व्यवसाय स्थल पर व्यवसाय से संबंधित कोई भी लेखा पुस्तक या कोई भी सॉफ्टवेयर जैसे कि टैली का संधारण नहीं पाया गया, जिससे कर अपवंचन की संभावना और भी प्रबल हो गई। आगे जांच में पाया गया कि वर्ष 2017-18 से वर्ष 2024-25 तक कुल टर्न ओव्हर लगभग रू. 158 करोड़ से अधिक है किंतु उस पर कर का नगद भुगतान शून्य किया गया है।

साथ ही साथ जब ई-वे बिल की जांच की गई तो पता चला कि वर्ष 2023-24 में माल की खरीदी 29.50 करोड़ की गई किंतु माल की सप्लाई मात्र रू. 50 लाख की ही की गई, जिससे यह पता चलता है कि माल का विक्रय आम उपभोक्ता को किया गया है किंतु बिल को अन्य व्यवसायियों को बेचकर बोगस इनपुट टैक्स का लाभ दिया गया है, जिससे कि केंद्र सरकार के साथ राज्य सरकार को कर राजस्व की अत्यधिक हानि हुई है। जांच के दौरान व्यवसायी के द्वारा अपनी गलती / त्रुटि स्वीकार करते हुए स्वैच्छिक रूप से रू. 40.00 लाख कर भुगतान करने की मंशा जाहिर की किंतु जीएसटी विभाग के अधिकारियों नें व्यवसायी से लेखा पुस्तक एवं अन्य दस्तावेज प्रस्तुत करने की मांग की। व्यवसायी की ओर से अभी तक कोई भी जानकारी एवं दस्तावेज प्रस्तुत नही किया गया है।

इसके साथ-साथ दिनांक 30.05.2025 एवं दिनांक 31.05.2025 को मेसर्स लक्ष्मी ट्रेडर्स, अंबिकापुर के व्यवसाय स्थल पर स्टेट जीएसटी विभाग अंबिकापुर द्वारा जांच की कार्यवाही की गई है। इनके यहां जांच में पाया गया कि वर्ष 2017-18 से वर्ष 2024-25 तक कुल टर्न ओव्हर लगभग रू. 96 करोड़ से अधिक है किंतु उस पर कर का नगद भुगतान नगण्य किया गया है। साथ ही साथ जब ई-वे बिल की जांच की गई तो ज्ञात हुआ कि वर्ष 2023-24 में माल की खरीदी 11 करोड़ की गई किंतु माल की सप्लाई मात्र रू. 7 करोड़ की ही की गई है।

जांच के दौरान व्यवसायी के द्वारा अपनी गलती / त्रुटि स्वीकार करते हुए स्वैच्छिक रूप से रू. 17.55 लाख कर भुगतान कर दिया गया है। उक्त व्यवसायी पर स्टेट जीएसटी विभाग द्वारा पूर्व में कोई कार्यवाही नहीं की गई है।
