बिलासपुर। छत्तीसगढ़ स्टेट बार काउन्सिल द्वारा महाधिवक्ता सतीश चंद्र वर्मा व तीन अन्य को जारी नोटिस पर हाईकोर्ट ने स्थगन देते हुए कौंसिल के अध्यक्ष प्रभाकर चंदेल से जवाब मांगा है। इधर कौंसिल के पूर्व अध्यक्ष कोसराम साहू सहित अन्य कई कौंसिल सदस्यों ने महाधिवक्ता को जारी नोटिस निरस्त करने की मांग कौंसिल अध्यक्ष से की है।
ज्ञात हो कि निःशक्त जन स्त्रोत संस्थान में गड़बड़ियों को लेकर हाईकोर्ट में एक याचिका दायर की गई थी। इसमें 1000 करोड़ रुपये के घोटाले की जांच की मांग की गई थी। हाईकोर्ट ने इस मामले में राज्य के कई प्रशासनिक अधिकारियों के खिलाफ सीबीआई जांच की आदेश दिये थे, जिस पर सुप्रीम कोर्ट से स्थगन मिल चुका है। याचिकाकर्ता कुन्दन सिंह ठाकुर की ओर से स्टेट बार कौंसिल को शिकायत की गई थी कि महाधिवक्ताओं ने सरकार उन प्रशासनिक अधिकारियों को कानूनी मदद पहुंचाई है। इसके आधार पर स्टेट बार काउन्सिल के सचिव द्वारा महाधिवक्ता को कारण बताओ नोटिस जारी किया गया था। नोटिस के खिलाफ महाधिवक्ता की ओर से अधिवक्ता निर्मल शुक्ला ने याचिका दायर करते हुए इसे निरस्त करने की मांग की थी। आज हाईकोर्ट ने मधिवक्ता के खिलाफ एकतरफा कार्रवाई करने पर स्थगन दे दिया है।
स्टेट बार काउन्सिल के पूर्व चेयरमेन कोसराम साहू ने महाधिवक्ता के खिलाफ की जा रही कार्रवाई को लेकर चेयरमेन को पत्र लिखा है और इसे अनीतिपूर्ण और संस्था की छवि को धूमिल करने वाला बताया है। उन्होंने महाधिवक्ता को जारी नोटिस अविलम्ब वापस लेकर पूर्व में परिषद् के समझ लम्बित व्यावसायिक कदाचरण के मामलों पर प्राथमिकता से कार्रवाई करने की मांग की है।
ज्ञात हो कि इससे पहले स्टेट बार कौंसिल के पूर्व कोषाध्यक्ष अशोक तिवारी, सदस्य जनार्दन त्रिपाठी, अवध त्रिपाठी व लीलाधर चंद्रा ने भी अलग-अलग पत्र लिखकर महाधिवक्ता के विरुद्ध कार्रवाई पर बार कौंसिल चेयरमेन के समक्ष आपत्ति दर्ज कराई है। जुलाई तक होना है नया चुनाव, महाधिवक्ता को चार्ज देने का प्रावधान
उल्लेखनीय है कि बार कौसिंल ऑफ इंडिया ने एक फरवरी 2020 को छत्तीसगढ़ बार कौंसिल का कार्यकाल खत्म होने के बाद छह माह की वृद्धि दी थी तथा इस बीच नया चुनाव कराने के लिए कहा था। यह अतिरिक्त कार्यकाल जुलाई में समाप्त हो रहा है। प्रावधान है कि यदि बार कौंसिल का कार्यकाल समाप्त हो जाता है और नई कार्यकारिणी गठित नहीं हो पाती है तो उसका प्रभार महाधिवक्ता को दिया जायेगा। जानकारी मिली है कि इस समय छत्तीसगढ़ बार कौंसिल की चुनाव प्रक्रिया प्रारंभ नहीं हुई है।
