17 साल की लड़की को अबॉर्शन कराने की मिली अनुमति: दुष्कर्म पीड़िता ने हाईकोर्ट में लगाई थी याचिका
बिलासपुर/ बिलासपुर हाईकोर्ट ने मानवीय आधार पर दुष्कर्म पीड़ित 17 साल की लड़की को अबॉर्शन कराने की अनुमति दी है। हाईकोर्ट ने पहले मेडिकल टेस्ट कराया और डॉक्टरों की राय मांगी। रिपोर्ट में पता चला कि लड़की 21 सप्ताह की गर्भवती है। उसका अबॉर्शन कराया जा सकता है।
अब जस्टिस एनके चंद्रवंशी ने पीड़िता का रायपुर स्थित पं. जवाहरलाल नेहरू मेडिकल कॉलेज में विशेषज्ञ डॉक्टरों की टीम की निगरानी में अबॉर्शन कराने के निर्देश दिए हैं।
दरअसल, बलौदाबाजार जिले की नाबालिग की युवक से जान-पहचान हुई। जिसके बाद उसने उसे प्यार के जाल में फंसा लिया। शादी करने का वादा किया। युवक ने उसके साथ दुष्कर्म किया और लगातार शारीरिक संबंध बनाते रहा। जिससे वह गर्भवती हो गई।
युवक ने उसे अपनाने से इनकार कर दिया। जिस पर उसने थाने में शिकायत दर्ज कराई। जिस पर पुलिस ने आरोपी युवक के खिलाफ केस दर्ज कर उसे जेल भेज दिया।
लड़की और परिजनों ने अबॉर्शन की अनुमति के लिए लगाई याचिका
गर्भवती लड़की और उसके परिजन को बिन ब्याही मां बनने से ऐतराज हुआ। लिहाजा, पहले उन्होंने स्थानीय प्रशासन से अबॉर्शन कराने की अनुमति मांगी। लेकिन, कानूनी प्रावधान के चलते उन्हें मदद नहीं मिली। इस पर उन्होंने हाईकोर्ट में याचिका दायर कर गर्भपात कराने की अनुमति मांगी। हाईकोर्ट ने इस मामले की सुनवाई करते हुए लड़की का मेडिकल कराने के निर्देश दिए।
विशेषज्ञ डॉक्टरों ने जांच के बाद दी रिपोर्ट
कोर्ट ने गर्भपात की अनुमति देने से पहले पीड़िता की शारीरिक और मानसिक स्थिति की जांच के लिए विशेषज्ञ डॉक्टरों की रिपोर्ट मंगाई थी। रिपोर्ट में पीड़िता को एनीमिया और सिकलसेल जैसी गंभीर बीमारियों से ग्रसित बताया गया, जिससे गर्भ बनाए रखना उसकी स्वास्थ्य स्थिति के लिए खतरनाक साबित हो सकता था।
भ्रूण और रक्त के नमूने सुरक्षित रखने का निर्देश
हाईकोर्ट ने गर्भपात के बाद भ्रूण के ऊतक और रक्त के नमूने सुरक्षित रखने का निर्देश भी दिया है। कोर्ट का कहना है कि भविष्य में डीएनए परीक्षण की आवश्यकता पड़ने पर ये नमूने उपयोगी हो सकते हैं।
गंभीर स्वास्थ्य जोखिम
अदालत ने अपने आदेश में कहा कि, गर्भ रोकने से पीड़िता की शारीरिक और मानसिक स्थिति पर गंभीर असर पड़ सकता है। वहीं, गर्भपात के दौरान भी सिकलसेल और एनीमिया जैसी जटिलताओं के कारण जोखिम बना रहेगा। कोर्ट ने नाबालिग और उसके अभिभावकों की सहमति से यह फैसला दिया।
